Online Gallery Terms of Service

These Online Gallery Terms of Service (“Terms”) outline the agreement between Russell Captures Photography (“Photographer”) and the client (“Client”) regarding the access, usage, and privacy of online photo galleries hosted through Pixieset.

1. Gallery Access

• Following the completion of the photography session, the Photographer will upload the final images to a password-protected online gallery hosted on Pixieset.

• The unique password for the gallery will be shared exclusively with the Client. The Client may share this password with whomever they choose at their own discretion.

2. Gallery Availability

• The online gallery will be available for the period specified in the Client’s signed contract prior to the photography session.

• After the specified period, the gallery may be removed from the platform unless otherwise agreed upon in writing.

3. Privacy and Visibility

• The gallery will only be publicly visible on the Photographer’s website if the Client has explicitly granted permission through the intake questionnaire completed before the session.

• The Photographer takes all reasonable precautions to protect the privacy and security of the gallery, including password protection and secure hosting through Pixieset.

4. Client Responsibility

• The Client is responsible for managing and sharing the gallery password. The Photographer is not liable for any unauthorized access resulting from password sharing by the Client.

5. Limitation of Liability

• While the Photographer implements standard security measures to protect the privacy of the images, the Client acknowledges that no system can be entirely secure.

• By accessing the gallery, the Client agrees that the Photographer will not be held liable for any unintended usage, distribution, or breach of privacy related to the photos once uploaded to the online gallery.

6. Copyright and Usage

• All images provided in the gallery remain the intellectual property of the Photographer. The Client receives personal usage rights as outlined in the original contract.

• Any commercial usage, resale, or modification of the images without prior written consent from the Photographer is prohibited.

7. Acceptance of Terms

By accessing the online gallery, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
